This page (together with our returns policy, privacy policy and acceptable use policy) tells you the terms and conditions on which we supply any of the products (Products) listed on our website www.seasaltcornwall.com (our site) to you. Please read these terms and conditions carefully and make sure that you understand them, before ordering any Products from our site. You should understand that by ordering any of our Products, you agree to be bound by these terms and conditions. These terms cover:

INFORMATION ABOUT US

We operate the website www.seasaltcornwall.com. We are Seasalt Limited, a company registered in England and Wales under company number 02259954 and with our registered office at Unit 8 Falmouth Business Park, Bickland Water Road, Falmouth, Cornwall TR11 4SZ. Our VAT number is GB 163 0367 27.

SERVICE AVAILABILITY

Our site is only intended for use by people resident in the countries listed in delivery policy and costs. We do not accept orders from individuals outside those countries.

YOUR STATUS

By placing an order through our site, you warrant that:

  • you are legally capable of entering into binding contracts
  • you are purchasing the products outside the course of your normal business or trade and not for resale.

HOW THE CONTRACT IS FORMED BETWEEN YOU AND US

After placing an order, you will receive an Email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a Product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been despatched (Despatch Confirmation). The contract between us (Contract) will only be formed when we send you the Despatch Confirmation.

The Contract will relate only to those Products whose despatch we have confirmed in the Despatch Confirmation. We will not be obliged to supply any other Products which may have been part of your order until the despatch of such Products has been confirmed in a separate Despatch Confirmation.

STOCK AVAILABILITY

We do try to ensure that we have good stock availability of all products. However, some goods may sell faster than we predict. If the item you have ordered is not in stock, we will do our best to get it for you as quickly as possible. If we cannot get the item we will cancel your order immediately and let you know by email.

If we can get the item, but cannot deliver it to you within our delivery policy, we will email you with the option to cancel your order.

CONFORMITY OF THE PRODUCTS

We warrant to you that any Product purchased from us through our site will, on delivery, conform in all material respects with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.

In the event that you have an issue with your Product, please refer to our Returns Policy. Please be aware that nothing in our agreement with you affects your legal rights relating to goods that don’t conform with the contract, whether this is due to issues of quality, description or otherwise. You can get advice about your legal rights from your local Trading Standards office or Citizens' Advice Bureau.

Every care has been taken to ensure that the descriptions and specifications of our products on this web site are correct. However, whilst the colour reproduction is an extremely close representation, a slight variation in the actual goods can occur.

PRICE AND PAYMENT

The price of the Products and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error.

If you are ordering from the UK, Isle of Man or Channel Isles all prices are shown in sterling and include 20% VAT on adult’s clothing and 0% VAT on Seasalt Gift Cards. If ordering from the Channel Isles, please select Channel Isles from the country field when entering your delivery details at checkout, this will deduct VAT for Channel Isles customers. 

Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Despatch Confirmation.

Tax and duty is handled by our fulfilment partner, Global-e. As all orders are shipped directly from the UK, you may have to pay customs fees when your parcel reaches your chosen shipping country. You are responsible for any import duties, customs and local sales taxes, and you’ll need to pay these fees to release your order from customs. We don’t have any control over customs and import tax and we can't tell you exactly how much you will be charged, as this varies widely depending on your shipping country. Any orders with a value above the threshold amount will be charged import fees, so we recommend contacting your shipping country’s customs office for more information before placing your order and checking Global-e’s terms and conditions of sale. Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined.

MISPRICINGS

Despite our best efforts, items in our online shop may occasionally be mispriced. We verify prices as part of our despatch procedures and if an item’s correct price is lower than the price shown online, we will charge you the lower amount and send you the item. If the item’s correct price is higher than the price shown online, we will contact you for instructions before the Despatch Confirmation is sent out. For the avoidance of doubt, Seasalt shall be under no obligation to honour the incorrect price or Order.

TO PAY FOR YOUR ORDER

Payment for all Products must be by credit or debit card, PayPal, Klarna or Apple Pay. We accept payment with Visa, MasterCard and American Express credit cards, as well as Maestro, Visa Electron and Visa Debit cards.

We do not accept payment by cheque.  

You can only see our price list in sterling, but we accept card payments from anywhere in the world.

To protect credit and debit cardholders, all payments are screened using 3D Secure (MasterCard SecureCode and Verified by Visa) and by an independent fraud prevention service. We may contact you for additional security purposes should we deem this necessary.

COMPLAINTS

In the event of you having a complaint or problem with any aspect of our service or the products we offer, please telephone us on +44 (0) 1326 640075 or click here to inform us by email. We take all complaints extremely seriously and we will try to rectify any problem quickly and effectively.

Our Customer Service representatives are available between 9:00am and 6.00pm (GMT) Monday to Friday, 9:00am and 5:00pm Saturday, and between 10:00am and 4.00pm on Sunday.

All complaints will be acknowledged within 1 working day and will be resolved as soon as possible. We will always keep you informed throughout the process of resolving your complaint and we will keep the details of your complaint confidential. We always welcome feedback from our customers and are continually looking at ways to improve our service.

Alternative dispute resolution

Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with the resolution of our complaints process, Alternative Dispute Resolution is available, including online dispute resolution at https://www.cedr.com/consumer/.

This website may include information and materials uploaded by other users of the site. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

Uploading content to our site

Whenever you make use of a feature that allows you to upload content to our site, or to make contact with other users of our site, you must comply with the content standards set out in our Acceptable Use Policy.

You warrant that any such contribution does comply with those standards, and you will be liable to us and indemnify us for any breach of that warranty. This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.

Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your content, but you are required to grant us a limited licence to use, store and copy that content and to distribute and make it available to third parties. The rights you license to us are described in Rights you are giving us to use material you upload below.

We also have the right to disclose your identity to any third party who is claiming that any content posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

We have the right to remove any posting you make on our site if, in our opinion, your post does not comply with the content standards set out in our Acceptable Use Policy.

You are solely responsible for securing and backing up your content.

We do not store terrorist content.

Rights you are giving us to use material you upload

When you upload or post content to our site, you grant us the following rights to use that content:

a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, distribute, prepare derivative works of, display, and perform that user-generated content in connection with the service provided by the website and across different media including to promote the site or the service forever.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

GENERAL

Risk and title

The Products will be your responsibility from the time of delivery.

Ownership of the Products will only pass to you when we receive full payment of all sums due in respect of the Products, including delivery charges.

Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with information by posting notices on our website. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.

Notices

All notices given by you to us must be given to us at Unit 8 Falmouth Business Park, Bickland Water Road, Falmouth, Cornwall TR11 4SZ or contactus@seasaltcornwall.com.  We may give notice to you at either the e-mail or postal address you provide to us when placing an order. Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee.

Transfer of rights and obligations

The contract between you and us is binding on you and us and on our respective successors and assignees. You may not transfer, assign, charge or otherwise dispose of a Contract, or any of your rights or obligations arising under it, without our prior written consent. We may transfer, assign, charge, sub-contract or otherwise dispose of a Contract, or any of our rights or obligations arising under it, at any time during the term of the Contract.

Events outside our control

We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control (Force Majeure Event).

Our performance under any Contract is deemed to be suspended for the period that the Force Majeure Event continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Force Majeure Event to a close or to find a solution by which our obligations under the Contract may be performed despite the Force Majeure Event.

Waiver

If we fail, at any time during the term of a Contract, to insist upon strict performance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under the Contract, this will not constitute a waiver of such rights or remedies and will not relieve you from compliance with such obligations.

A waiver by us of any default will not constitute a waiver of any subsequent default.

No waiver by us of any of these terms and conditions will be effective unless it is expressly stated to be a waiver and is communicated to you in writing.

Severability

If any court or competent authority decides that any of the provisions of these terms and Conditions or any provisions of a Contract are invalid, unlawful or unenforceable to any extent, the term will, to that extent only, be severed from the remaining terms, which will continue to be valid to the fullest extent permitted by law.

Entire agreement

These terms and conditions and any document expressly referred to in them constitute the whole agreement between us and supersede all previous discussions, correspondence, negotiations, previous arrangement, understanding or agreement between us relating to the subject matter of any Contract.

We each acknowledge that, in entering into a Contract, neither of us relies on any representation or warranty (whether made innocently or negligently) that is not set out in these terms and conditions or the documents referred to in them.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

Please note that we only provide our site for domestic and private use. You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

Our right to vary these terms and conditions

We have the right to revise and amend these terms and conditions from time to time. You will be subject to the policies and terms and conditions in force at the time that you order products from us, unless any change to those policies or these terms and conditions is required to be made by law or governmental authority (in which case it will apply to orders previously placed by you), or if we notify you of the change to those policies or these terms and conditions before we send you the Despatch Confirmation (in which case we have the right to assume that you have accepted the change to the terms and conditions, unless you notify us to the contrary within seven working days of receipt by you of the Products).

Jurisdiction

Contracts for the purchase of Products through our site and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) will be governed by English law. Any dispute or claim arising out of or in connection with such Contracts or their formation (including non-contractual disputes or claims) will be subject to the exclusive jurisdiction of the courts of England and Wales.

Third party rights

A person who is not party to these terms and conditions or a Contract shall not have any rights under or in connection with them under the Contracts (Rights of Third Parties) Act 1999.

USE AND DISCLOSURE OF INFORMATION

Your information is treated in accordance with our Privacy Policy.

SEASALT GIFT CARDS

Seasalt Gift Cards can only be purchased in the UK & Channel Isles via our UK website, in Seasalt shops (in the UK only) or over the phone with our Customer Services team. To find your nearest shop, please visit www.seasaltcornwall.com/locations.

Seasalt Gift Cards are available from a minimum value of £5 to a maximum value of £500.

Your Seasalt Gift Card will be valid for 24 months from the date given on its face.

After 24 consecutive months your Seasalt Gift Card will expire and the balance on the card will be lost.

Seasalt Gift Cards can only be redeemed on UK & Channel Isles purchases via our UK website, in Seasalt shops (in the UK only) or over the phone with our Customer Services team. To find your nearest shop, please visit www.seasaltcornwall.com/locations.

For the avoidance of doubt, Seasalt Gift Cards cannot be redeemed in our Clonakilty and Westport shops or on our International and Republic of Ireland websites.

To use an Email Gift Card, download it following the instructions in the email.

To use your Seasalt Gift Card online, select ‘Redeem a Gift Card’ at the checkout, then enter the 16-digit number and PIN.

To use your Seasalt Gift Card in a Seasalt Shop (UK only), simply show your Email Gift Card on your phone or tablet or print your Seasalt Gift Card PDF and present it at the till.

If you’d like to spend your Seasalt Gift Card on something that costs more than the Gift Card value, you will simply need to pay the difference.

If you’d like to spend your Seasalt Gift Card on something that costs less than the Gift Card value, the amount of your purchase will be deducted and you can then use the remaining balance for future purchases. We are not able to give change.

Seasalt Gift Cards cannot be exchanged for cash.

Balances from a Seasalt Gift Card cannot be transferred onto another Seasalt Gift Card. Seasalt Gift Cards cannot be used to purchase Seasalt Gift Cards.

For balance enquiries, please ask in any Seasalt shop (UK only) or check your balance online at www.seasaltcornwall.com/check-giftcard-balance.

Take care of your Seasalt Gift Card, as you would cash – Seasalt will not accept liability for lost, stolen or damaged Seasalt Gift Cards.

Seasalt will cancel the value of the Seasalt Gift Card where the fraudulent use of a credit card is suspected.

If you’d like to refund or exchange something purchased with a Seasalt Gift Card the Seasalt Refund Policy will apply. This does not affect your statutory rights.

Seasalt reserves the right to amend our Seasalt Gift Card Terms & Conditions at any time and to take appropriate action, including the cancellation of the Gift Card, if we deem such action necessary. This does not affect your statutory rights.

Seasalt reserves the right to refuse to accept a Seasalt Gift Card in payment or part, where it reasonably suspects that the Seasalt Gift Card or any amount on it may have been stolen, tampered with, duplicated or obtained in another illegal way.

Seasalt Gift Cards will be verified at the time of payment and each individual shop reserves the right not to accept any Gift Card if it has or appears to have been forged, damaged, defaced or otherwise tampered with.

SEASALT SHOP LOYALTY CARD

  • These Terms and Conditions, together with the Seasalt Cornwall privacy policy, govern the Seasalt Shop Loyalty scheme, and any application for participation in the scheme will be treated as acceptance of these terms and conditions. Additional terms and conditions may apply for additional elements of the scheme, such as competitions and prize draws.
  • Our Seasalt Shop Loyalty Cards launches on 15th June 2019 until further notice.
  • Seasalt Shop Loyalty Cards can be used in UK Seasalt shops (excluding outlets and stockists). Find your nearest shop here.
  • Seasalt Shop Loyalty Cards cannot currently be used in our Westport, Clonakilty or outlet stores, in any Seasalt stockists or online.
  • Seasalt Shop Loyalty Cards cannot be exchanged for cash.
  • Seasalt Shop Loyalty Cards are not valid against the purchase of Seasalt Gift Cards.
  • Each card belongs to the customer who registered it, cards cannot be shared. Members of the Loyalty Scheme are entitled to one membership only. Stamps are non-transferrable and may not be “saved up” and added to someone else’s card.
  • Stamps are awarded for every £50 spend in one transaction only, stamps cannot be awarded for multiple transactions totalling £50 or over. Stamps will also be awarded for online purchases. Simply bring your Order Confirmation email into any Seasalt Shop (UK only) to claim your stamp. Stamps must be claimed within 28 days of any transaction.
  • You can claim loyalty stamps for up to 4 online orders or transactions by visiting a Seasalt shop. Please take copies of your Order Confirmation emails/ order numbers/ receipts with you. 
  • To claim loyalty stamps for 5 or more online orders/ transactions, e-mail contactus@seasaltcornwall.com. Include in your e-mail, the order numbers you wish to make a claim for and your contact details. If you have an existing loyalty card, please include the card number.  The customer service team will then issue your loyalty stamps. Please allow at least 2 weeks for the team to issue your loyalty stamps. We’re sorry, our Seasalt shops are not able to issue loyalty stamps for 5 or more online orders at any one visit. 
  • You must provide the required personal details to sign up (customer name and email address or address are the minimum requirement). We will use your contact details to let you know about Seasalt offers, products and services that are the most likely to interest you. The GDPR allows us to do this as part of our legitimate interest in understanding our customers and providing the highest levels of service. As a member of the Loyalty Card scheme we will also send you news and information about Seasalt events that will enable you to earn more stamps. It also helps us check for fraud. If you decide you do not wish to share your personal data with us any more, you can ask us to delete it (please see our Privacy Policy for more details) but if you do this we may not be able to provide some of the services you have asked for.
  • Seasalt reserves the right to amend our Seasalt Shop Loyalty Card Terms & Conditions at any time and to take appropriate action, including the cancellation of the card, if it becomes necessary. This does not affect your statutory rights.
  • Seasalt will not accept liability for lost or stolen Seasalt Shop Loyalty Cards but damaged cards may be replaced at Seasalt’s discretion.
  • Seasalt reserves the right to cancel a Seasalt Shop Loyalty Card, where the fraudulent use of a credit card is suspected, or where Seasalt suspects a breach of these Terms & Conditions or abuse of the scheme, or any behaviour relating to the scheme that involves theft, misconduct, offensive or misleading behaviour.
  • Seasalt reserves the right to refuse to accept a Seasalt Shop Loyalty Card, where it reasonably suspects that the Seasalt Shop Loyalty Card may have been stolen, tampered with, duplicated or obtained in another illegal way.
  • Seasalt Shop Loyalty Cards will be verified at the time of issue and each individual shop reserves the right not to accept any Seasalt Shop Loyalty Card if it has or appears to have been forged, damaged, defaced or otherwise tampered with.
  • Only one Seasalt shop loyalty card exclusive coupon obtained from the August 2019 catalogue may be used per loyalty card.
  • By signing up for a Seasalt Shop Loyalty Card, you are accepting and will be bound by these Terms & Conditions.
